Jersey Laws and orders brought into force in 2011 – as at April 11 2012
- The Financial Services (Trust Company Business) (Exemptions Amendment No. 2) (Jersey) Order 2010 came into force in part on 24 November 2010, with the remainder coming into force on 17 February 2011.

- The Order amends the Schedule to the Financial Services (Trust Company Exemptions) (Jersey) Order 2000 by extending the exemption under Paragraph 13 so that registration will not be required if an individual acting as a director is a director of no more than six companies (not including directorships which are within the ambit of other exemptions but including directorship of the company in question).
- It also, from 17 February 2011, amends the Schedule to the Financial Services (Trust Company Exemption No. 4 ) (Jersey) Order 2004 to make the conditions for exemption from registration under Article 7 of the Financial Services (Jersey) Law 1998 of “connected persons” under that Schedule cumulative – in other words, both conditions (a) and (b) must now be fulfilled.
- The Financial Services (Trust Company Business (Exemptions No. 3)) (Amendment) (Jersey) Order 2011 came into force on 10 October 2011.
- The Order brings general partners of Separate Limited Partnerships and Incorporated Limited Partnerships within the same exemption as applies to general partners of partnerships formed under the Limited Partnerships (Jersey) Law 1994.
- The Companies (Amendment No. 5) (Jersey) Regulations 2011 came into force on 23 February 2011.
- The Regulations amend the Companies (Jersey) Law 1991 in relation to cross-border mergers.
- The Companies (Amendment No. 6) (Jersey) Regulations 2011 came into force on 20 July 2011.
- The Regulations make consequential amendments to the Companies (Jersey) Law 1991 following the coming into force of the Incorporated Limited Partnerships (Jersey) Law 2011.
- The Control of Borrowing (Amendment No. 14) (Jersey) Order 2011 came into force on 10 October 2011.
- The Order amends Article 10 of the Control of Borrowing (Jersey) Order 1958 to include Separate Limited Partnerships and Incorporated Limited Partnerships.
- The Employment (Amendment No. 5) (Jersey) Law 2010 came into force in part on 1 January 2011 and in part on 1 June 2012.
- The Law amends the Employment (Jersey) Law 2003 to establish a right to a redundancy payment equivalent to one week’s wages per year of employment (subject to a cap and certain conditions) for those employees who have completed at least two years’ continuous employment with the employer. It also sets out detailed new consultation obligations to apply in redundancy situations and makes a number of other changes.
- The Gambling (Remote Gambling Disaster Recovery) (Amendment) (Jersey) Regulations 2011 came into force on 17 March 2011.
- The Regulations make provision for the operation of e-gambling in Jersey.
- The Income Tax (Amendment No. 39) (Jersey) Law 2011 came into force on 22 July 2011.
- The Law amends the Income Tax (Jersey) Law 1961 in order to introduce a new tax regime for individuals granted a housing consent under Regulation 1(1)(k) of the Housing (General Provisions) (Jersey) Regulations 1970.
- The Income Tax (Prescribed Limit and Rate) (Amendment) (Jersey) Regulations 2011 came into force on 22 July 2011.
- The Regulations prescribe Income Tax limits and rates in relation to individuals granted a housing consent under Regulation 1(1)(k) of the Housing (General Provisions) (Jersey) Regulations 1970.
- The Incorporated Limited Partnerships (Jersey) Law 2011 came into force on 26 May 2011.
- The Law allows for the establishment of incorporated limited partnerships in Jersey. An incorporated limited partnership is a limited partnership which is a body corporate with separate legal personality and unlimited capacity in terms of its activities and perpetual succession.
- The Incorporated Limited Partnerships (Jersey) Order 2011 came into force on 26 May 2011.
- The Order prescribes interest payable under the Incorporated Limited Partnerships (Jersey) Law 2011.
- The Incorporated Limited Partnerships (Jersey) Regulations 2011 came into force on 26 May 2011.
- The Regulations deal with the winding up of Incorporated Limited Partnerships. The provisions are based on the equivalent Articles in the Companies (Jersey) Law 1991.
- The Separate Limited Partnerships (Jersey) Law 2011 came into force on 20 April 2011.
- The Law allows for the establishment of separate limited partnerships in Jersey. A separate limited partnership is a limited partnership with its own legal personality distinct from that of its partners.
- The Separate Limited Partnerships (Jersey) Order 2011 came into force on 20 April 2011.
- The Order prescribes interest payable under the Separate Limited Partnerships (Jersey) Law 2011.
- The Wills and Successions (Amendment) (Jersey) Law 2010 came into force on 29 January 2011.
- The Law amends the Wills and Successions (Jersey) Law 1993 in relation to the treatment of illegitimate children for succession purposes in order to provide the same rights as legitimate offspring.
