AN INSPECTOR CALLS…EMERGENCY CHECKLIST – the Golden rules –

General∙∙

  1. Be polite but firm ∙∙
  2. Stay calm, be factual∙∙
  3. If you don’t know the answer to a question, say so∙∙
  4. Tell the truth; never speculate even if asked to do so∙∙
  5. Be helpful (non-compliance may be a crime) but don’t answer incriminating questions∙∙
  6. Consider your media strategy – see insert to this pack “unwanted media attention?”–

When the inspectors arrive∙∙

  1. Check identity, authorisation (warrant?) and scope of investigation ∙∙
  2. Notify these people immediately –
    • anyone for whom the officials ask by name –
    • Managing Director –
    • in-house legal –
    • relevant inspection contact person–

When the inspection is underway∙∙

  1. Ensure you keep up to date with the progress of the inspection∙∙
  2. Always accompany investigating officials ∙∙
  3. Keep a record of everything the inspectors do ∙∙
  4. Do not allow inspectors to go beyond the scope of the investigation ∙∙
  5. Do not let inspectors have documents which are privileged or outside scope of investigation–

When the inspectors leave∙∙

  1. Ensure you have a complete copy of all documents/records taken away by inspectors∙∙
  2. Consider your post-raid strategy
